A party wall job goes wrong on a date, not on the building work
- Counted back from the day the builder wants to start. A party structure notice runs two months ahead of the work and a line of junction or excavation notice one month, so the day you can still serve is a subtraction from your start date, and it is usually closer than people think.
- Silence is a dissent, and a dissent is an award. An adjoining owner who says nothing within fourteen days is deemed to have dissented, and a deemed dissent puts surveyors and an award into a job that was going to be a letter. Knowing that before you serve changes how you write to the neighbour.
- What you served in March, still readable in three years. The schedule of condition is the whole defence against a crack the neighbour finds later, and it is only a defence if the photographs, the date and the notice that produced it are still together.
